AMC Media explicitly excludes, to the extent that is permissible by law, any liability for direct or indirect damage, as well as consequential damage allegedly caused to a User, when that User’s behaviour has contributed to the production of the damage allegedly suffered. Nor when the User has failed all or part in the performance of obligations under these Terms.

23. Exclusions and Limitations

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.IN SUCH JURISDICTIONS, AMC MEDIAS’S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

24. Indemnity

To the maximum extent permitted by applicable law, the User agrees to hold harmless, defend and indemnify AMC Media, its officers, directors, shareholders, employees, contractors, agents, licencors, co-branders or other partners, and any other authorized agent or representative, or its affiliate companies or associates, from any and all loss, liability, demand, penalty, claim, legal proceeding, cause of action, damage, expense, action, settlement, recovery, fine,including without limitation, reasonable legal fees of every kind and nature and other costs arising out from

  • Your purchase or use of any services offered through the website;
  • Your breach of these Terms and any other policies or rules herein incorporated;
  • Your violation of any law or the rights of a third party;

The User shall cooperate as fully as reasonably required in the defense of any claim. AMC Media,reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User. The User’s indemnification obligation shall survive the User’s termination of or cessation of use of the website.

25. Dispute Resolution

If a dispute arises out of this Agreement, the Parties shall seek to resolve it by negotiation on an amicable basis. For this matter, you agree to first contact us at legal@aaronmac.co and attempt to resolve the dispute with us informally.

If the dispute has not been resolved by negotiation as provided herein, any dispute arising out of or in connection with this contract, including any question regarding its existence, validity or termination, shall be subject to the exclusive jurisdiction of the Courts of the state of Victoria, Australia.This contract shall be governed by and construed in accordance with the laws of the state of Victoria, Australia.

26. Final Dispositions

  • These Terms and any further rules, policies, or guidelines incorporated by reference, shall be governed by and construed in all respects in accordance with the laws of the state of Victoria, Australia. The parties hereby irrevocably consent to the personal jurisdiction and venue therein;
  • These Terms constitute the final and entire agreement between AMC Media, and the User;
  • These Terms supersede and replace all previous Terms and shall replace any Terms previously notified to the User;
  • The rights and obligations assigned under these Terms are personal to the User, and cannot be assigned to anyone;
  • AMC Media ´s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision;
  • if any provision of these Terms and conditions is found to be invalid by any competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms which shall continue to have full force and effect.

The Service is distributed on an "as is" basis. No warranties or guarantees are made in any of the material. You acknowledge taking full responsibility in the decisions you make after being coached or after receiving consulting services, as well as the consequences. You also acknowledge that you are responsible for creating your own results.

AMC Media does not guarantee nor imply any specific outcome or success of any kind. AMC Media does not constitute nor is a substitute for legal, financial, psychological, or any other type of professional advice.

Where permitted by law, you acknowledge that the Service is provided without any warranties of any kind whatsoever either express or implied, including but not limited to the implied warranties of fitness for a particular purpose, merchantability and non-infringement, or compliance with laws or government rules or regulations applicable to the product or Services. You acknowledge that use of the Service is at your own risk.

8. Registration

By registering for an account as a User, you represent and warrant that you are at least 18 years old and that you are legally capable of entering into binding contracts. Any person who violates this condition will be subject to unilateral cancellation of the Service without notice. By using the Service, you also warrant to us that you agree to be financially responsible for all charges, fees and other sums of whatever nature which arise out of your use of the Service. To access the Services, the User will create an account that is administered independently by them. The User will choose a username and password to access their account. Any use of these with a purpose other than intended, may allow AMC Media, to terminate this agreement and cancel your registration at its own discretion, without prior notice. Users are solely responsible for all activities which occur under their account whether authorized or not authorized. AMC Media may disable your account in its sole discretion and without notice if we believe that you have violated these Terms.

To purchase any of the product or Services, please follow the steps on our web site under the “place an order” tab. Full payment is due at registration. When you place an order for a Service you are offering to purchase that Service on these Terms. We reserve the right to decline or cancel your order, or any part of your order.

Following receipt by us of your order for a Service and the fee related to the Service, you will receive an automated email confirming that your order has been received by us. Your order will be subject to acceptance by us of your offer to purchase.A legally binding agreement shall not come into existence until we have accepted your offer to purchase a Service.

9. Services

In order to use the Service participant must have access to a computer with a Broadband Internet connection (500+ Kbps or more) and be able to play sound using a headset or speakers.

The Services include an online educational program, featuring training Services, 1:1 coaching and consulting services.The Service involves a combination of coaching videos, written materials and other tools and information, and in some cases, tutoring support, including video consultations and training, all delivered online. Please see a general description of the available programs on our website for details of the contents.

We reserve the right to change the Service content of any Service at any time and without notice.Except as set out in the description on the website, no additional Services or materials will be provided by us.

By placing your order or clicking “accept,” you agree to be bound by this Agreement. We will use reasonable skill and care in providing the Service to you. We will do so according to the qualification content set out in the agreement. We do not make any commitment to you that the content of the Service will meet any specific requirements that you have. We expect you to take reasonable care to make sure that the Service you have chosen will meet your needs.

Within 24 hours of purchase, a confirmation email will be sent to you acknowledging successful enrollment in the Service. To access the content, you will be asked to create an account and to choose a username and password.

Upon successful completion of the program, you may receive a certificate if applicable.

  • to supervise and control use of the materials and documents and ensure that they are used in accordance with the terms of this licence;
  • not to provide or otherwise make available the materials or documentation provided in whole or in part, in any form to any person without prior written consent from the Licensor

Any use of the Service not permitted in these Terms and the Terms and Conditions of the website is strictly prohibited. Such use will constitute an infringement of either our copyright or our other intellectual property rights, or the copyright or other intellectual property rights of people who provide Services to us.

12. Refunds and Cancellations

Cancellation and refunds are available and may be issued within 30 days of the purchase date. To make a refund request, please submit an email request to support@aaronmac.co. Requests must provide proof of the completed work, weekly challenges, call attendance, and group engagement, and must be submitted before midnight of the end of the 30-day period. If there is no sufficient evidence, no refund will be issued. Refunds cannot be made for downloadable digital items.

14. Intellectual Property

We remain the owner of the intellectual property of any of the Services, products, materials and documents offered. No materials related to the Services, nor any part thereof may be reproduced, stored in a retrieval system or transmitted any form or by any means without our prior written permission. The rights of use granted by AMC Media, to our Users are strictly limited for private and personal purposes.You may not modify copy, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit, make available, disseminate or distribute in any way any of the Course materials without the prior express written permission of AMC Media.The use of the documents and materials not expressly permitted in these Terms is strictly prohibited and will constitute an infringement of our copyright or our other intellectual property rights, and/or the copyright or other intellectual property rights of our licensors.

15. Relationship of the Parties

This agreement does not create a joint venture, partnership, or principal/ agent relationship between the parties and nothing in this agreement may be used to imply such a relationship.

16. Term and Termination

The duration of this Agreement shall the term indicated on your order form. Failure to pay for the Services will result in termination of the Services prior to the end of the applicable term, and your access to the program and/or materials and any other Services shall be discontinued.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER US NOR ANYONE ELSE WHO HAS BEEN INVOLVED ON BEHALF OF USIN THE CREATION, PRODUCTION OR DELIVERY OF THE SERVICE OR ANY SERVICES PROVIDED IN CONNECTION THEREWITH, SHALL BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING DAMAGE FOR LOSS OF BUSINESS PROFIT, BUSINESS INTERRUPTION, LOSS OF DATA, AND THE LIKE) ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY FOR LOSS OR DAMAGE UNDER THIS AGREEMENT EXCEED THE AMOUNT OF FEES PAID BY YOU FOR THE SERVICE.

18. Indemnity

To the maximum extent permitted by applicable law, the User agrees to hold harmless, defend and indemnify AMC Media, its officers, directors, shareholders, employees, licensors, co-branders or other partners, and any other authorized agent or representative, or its affiliate companies or associates, from any and all loss, liability, demand, penalty, claim, legal proceeding, cause of action, damage, expense, action, settlement, recovery, fine,including without limitation, reasonable legal fees of every kind and nature and other costs arising out from

(i)your purchase or use of the Service;

(ii)your breach of these Terms, our web site terms and any other policies or rules herein incorporated;

(iii)your violation of any law or the rights of a third party;

(iv)your negligence or misconduct;

(v)any other activities in connection with the Service or in any way related to your use of AMC Media,which AMC    Media, may suffer from your activities or use of the Service.

19. Final Dispositions

  • These Terms and any further rules, policies, or guidelines incorporated by reference, shall be governed by and construed in all respects in accordance with the laws of the State of Victoria, Australia. The parties hereby irrevocably consent to the personal jurisdiction and venue therein;
  • These Terms constitute the final and entire agreement between AMC Media, and the User;
  • These Terms supersede and replace all previous Terms and shall replace any Terms previously notified to the User;
  • The rights and obligations assigned under these Terms are personal to the User, and cannot be assigned to anyone;
  • AMC Media´s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision;
  • If any provision of these Terms and conditions is found to be invalid by any competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms which shall continue to have full force and effect.
